Agreement to Terms

By accessing or using Speedway Collective (https://www.speedwaycollective.com), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the service.

Description of Service

Speedway Collective is a free fantasy NASCAR platform that allows users to create and participate in fantasy racing leagues. Users can select drivers, manage rosters, compete in leagues, and track statistics across multiple NASCAR series.

User Accounts

Registration

To use certain features of our service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

User Conduct

You agree not to:

  • Violate any applicable laws or regulations while using the service
  • Infringe upon the rights of others, including intellectual property rights
  • Transmit any harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the service or other users' accounts
  • Use the service for any illegal or unauthorized purpose
  • Interfere with or disrupt the service or servers connected to the service
  • Use automated systems (bots, scrapers) to access the service without permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

League Participation

League Rules

Each league may have its own rules and scoring system. By joining a league, you agree to abide by that league's rules as set by the league administrator.

Fair Play

All users are expected to participate fairly and honestly. Any attempt to manipulate results, exploit bugs, or engage in cheating may result in immediate account suspension or termination.

League Administration

League administrators have the authority to manage their leagues, including adding or removing members, adjusting settings, and resolving disputes within their league.

Intellectual Property

Our Content

All content on Speedway Collective, including but not limited to text, graphics, logos, images, and software, is the property of Speedway Collective or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

User Content

You retain ownership of any content you submit to the service. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the service.

NASCAR Content

NASCAR, driver names, team names, and related marks are trademarks of their respective owners. We use this content under fair use principles for informational and fantasy sports purposes only.

Service Availability

We strive to provide reliable service but do not guarantee that the service will be available at all times. We reserve the right to:

  • Modify or discontinue the service at any time
  • Perform maintenance that may temporarily interrupt service
  • Limit access to certain features or content

League Admin Pro

What is League Admin Pro?

League Admin Pro is a premium league administration service that unlocks advanced features for league commissioners. League Admin Pro provides enhanced customization options including custom scoring settings, custom driver starts, roster lock time control, past champions management, and the ability to add unlimited league members (beyond the standard 20-member limit).

League Admin Pro is a one-time purchase per season. When you purchase League Admin Pro, you gain access to premium features for the current season only. If you wish to use League Admin Pro features in a subsequent season, you will need to purchase it again for that season.

Payment and Billing

All payments for League Admin Pro are processed through Stripe, a third-party payment processor. By purchasing League Admin Pro, you agree to Stripe's terms of service and privacy policy. Payment information is handled securely by Stripe and is not stored on our servers.

All prices are displayed in U.S. Dollars (USD) and are subject to change at any time. We reserve the right to modify pricing for future purchases, but price changes will not affect purchases already completed.

Feature Availability and Changes

We reserve the right to modify, add, or remove features included in League Admin Pro at any time. While we strive to maintain feature consistency, we may update or change features to improve the service, address technical issues, or respond to user feedback. We will make reasonable efforts to notify users of significant feature changes, but we are not obligated to provide advance notice for all modifications.

League Admin Pro features are provided on an "as is" basis. We do not guarantee that all features will be available at all times or that features will function without errors or interruptions.

Refund Policy

All purchases of League Admin Pro are final. We do not offer refunds for League Admin Pro purchases except as required by applicable law. If you believe you are entitled to a refund under applicable law, please contact us at speedwaycollective@gmail.com with your purchase details and reason for the refund request.

If your account is terminated for violation of these Terms, you will not be entitled to a refund for any unused portion of your League Admin Pro subscription.

Termination of League Admin Pro Access

We reserve the right to suspend or terminate your access to League Admin Pro features at any time, with or without notice, if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary. Termination of League Admin Pro access does not entitle you to a refund.

If your account is terminated, your access to League Admin Pro features will be immediately revoked, and you will lose access to all premium features associated with your league(s).

Limitation of Liability for League Admin Pro

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Speedway Collective SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF LEAGUE ADMIN PRO, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF LEAGUE SETTINGS, OR INABILITY TO ACCESS PREMIUM FEATURES. IN NO EVENT SHALL OUR TOTAL LIABILITY FOR LEAGUE ADMIN PRO EXCEED THE AMOUNT YOU PAID FOR THE SERVICE.

We are not responsible for any loss or damage resulting from changes to features, service interruptions, or discontinuation of League Admin Pro features.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, secure, or error-free, or that defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Speedway Collective SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless Speedway Collective, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the service or violation of these Terms.

Termination

We reserve the right to suspend or terminate your account and access to the service at any time, with or without cause or notice, for any reason, including violation of these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
